Sen. Bayh Could Be Swing Vote in Roberts Confirmation

Democratic Sen. Evan Bayh could be the swing vote when the Senate casts ballots to confirm or reject John Roberts' nomination as Chief Justice.

The Indiana lawmaker introduced Roberts at the confirmation hearing on Monday but is reportedly still undecided about his confirmation.

"It's pretty clear that Ted Kennedy's not going to be voting for John Roberts on this next confirmation," said Luke Messer, executive director of the Indiana GOP.

"The White House is looking at the senators who might potentially cross over from the other side of the aisle to vote for this nominee and they've identified Senator Bayh as one of those potential crossovers."

It's possible that the White House will need Democratic votes to avoid a filibuster over Roberts' confirmation, wishtv.com in Indiana reports, adding:

"Republican calculations indicate that, if that scenario comes about, Evan Bayh could end up being the swing vote."
