RNC: Sen. Kennedy's Attack on Judge Alito 'Laughable'

Sen. Ted Kennedy (D-Mass.) sent a letter to Judge Sam Alito on Monday, asking the judge to explain his actions with regard to a case involving Vanguard mutual funds.

Today, the Republican National Committee responded to the Democratic Senator's lengthy missive.

"It's laughable that Ted Kennedy of all people is attacking Judge Alito's integrity.

"Senator Kennedy was one of the most outspoken defenders of Judge Stephen Breyer during his confirmation hearing when similar issues arose just over a decade ago.

"Just as he did with Chief Justice Roberts, Ted Kennedy will undoubtedly oppose Judge Alito's nomination.

"All he's doing is injecting naked partisan politics into what should be a dignified process."

Senator Kennedy voted against Chief Justice John Roberts' confirmation after peppering him with questions about his views on minority voting rights.

In an earlier letter, Kennedy said Roberts "... was on or beyond the outer fringe of that extreme group eager to take our law and society back in time on a wide range of issues of individual rights and liberties."

In his current letter, Kennedy acknowledges that there may be fireworks at Alito's confirmation hearings, writing that "In the interests of a smoother and less confrontational confirmation process." he would like Alito to answer his questions.

Meanwhile, Kennedy seemingly belittles Alito earlier in his letter, asking as a schoolteacher might, "Do you understand why courts, including the Supreme Court, have insisted on properly constituted panels as a prerequisite to effective judicial action?"

Alito's Judiciary Committee hearing begins on Jan. 9th. Chairman Arlen Specter outlined a timetable that envisions five days of hearings, followed by a vote in committee on Jan. 17 and the full Senate on Jan. 20.
