Grand Jury Weighs Condit Obstruction

Anne Marie Smith's lawyer had asked the grand jury last week to issue an indictment charging Condit with impeding the investigation into the disappearance of Chandra Levy by attempting to pressure Smith into signing an affidavit denying that she had been intimately involved with Condit.

Condit has denied having an affair with Smith and he has not been named as a suspect in Levy's disappearance in Washington last spring. Smith's attorney, James Robinson, told the Modesto Bee that neither he nor Smith had been called to testify.

Robinson, along with Sterling Norris, an attorney for the conservative group Judicial Watch, contended that Condit's chief of staff, Mike Lynch, had first contacted Smith in a telephone call placed in Modesto, which would give Stanislaus County jurisdiction.

Some legal experts, however, were doubtful the grand jury would go as far as to indict Condit, Lynch or Don Thornton, an investigator for Condit's legal team.

Frank Zimring, a professor at the University of California at Berkeley School of Law, told the Modesto Bee that the contention that the alleged conspiracy originated in Stanislaus County was one "hell of a stretch."

"Oh, it's possible," he opined. "I'd say the chances are right up there with winning the California Lottery."
