Florida's So-Called Supreme Court: No Justice

Wednesday, 22 November 2000 12:00 AM

These seven robed liberals, caring not what the law of Florida says, caring not what a lower Democrat judge ruled, caring not what a coequal branch of government, in the person of Secretary of State Harris, determined, has spasmed forth an opinion that hand recounts can proceed and be counted in three Democrat counties, despite the fact that such recounts can only proceed, as provided by Florida statute, if there is an allegation of fraud or mechanical breakdown in the counting machines. Neither ground has even been alleged by the complaining party.

What comes next, or better yet, what should come next? Secretary of State Katherine Harris should certify the machine recount vote of Florida, thereby declaring George W. Bush the winner. At that moment there will be two coequal branches of government in disagreement as to how this state's slate of electors shall be chosen to vote in the Electoral College on Dec. 18.

As reported three days ago here at NewsMax.com, the judiciary vs. executive branch standoff triggers Title 3, Section 2 of the United States Code, which provides that in any instance in which a state cannot decide who the electors are, the state's legislature may decide. Political disputes should be resolved politically, which is precisely why this federal statute is there.

Already former Secretary of State Jim Baker, in his post-decision press conference, indicated this option is very much on the table.

This thing must go to the Florida legislature – now.
