It's unlikely President Donald Trump could refuse to answer questions from special counsel Robert Mueller's team as part of the Russia investigation, according to a new analysis.

NBC News cited cases and instances when former presidents had to testify. Trump could cite the Fifth Amendment and refuse to testify against himself, but that move could be politically damaging.

It was reported Monday that Mueller's team may interview Trump within weeks as the Department of Justice investigates whether the Trump campaign colluded with Russia.

NBC reported that no president in history has refused to testify when asked to do so. It referenced two Supreme Court rulings — one in 1974 that said President Richard Nixon could not cite executive privilege to keep the infamous White House recordings from being submitted as evidence in the Watergate case and another in 1997 that ruled President Bill Clinton did not have immunity after Paula Jones sued him for sexual harassment.

As part of its ruling in Clinton v. Jones, the court said, "It is also settled that the president is subject to judicial process in appropriate circumstances."

The ruling added, "If Congress deems it appropriate to afford the president stronger protection, it may respond with appropriate legislation."

NBC cited two former counsels to Republican and Democratic presidents who said other than the Fifth Amendment, Trump does not have any legal right to refuse to testify or answer questions.

In June, Trump said he would be willing to speak with Mueller's team if asked to do so.
