McCaul: Carnage in Texas Church Could Have Been Stopped

The tragedy of the church shootings in Texas on Sunday isn't only that 26 people lost their lives, but that the carnage could have been stopped, Texas Rep. Mike McCaul said Thursday.

"I think under federal law if you are convicted of a felony or domestic violence crime, which was the case here, it needs to be reported in the criminal database," the Republican senator, who serves as House Homeland Security Committee chairman, told Fox News' "America's Newsroom" program.

The shooter, Devin Kelley, 26, had received a bad-conduct discharge from the Air Force after spending a year in custody for abusing his wife and her infant son. In addition, at one point, while he was still in the military, he had escaped from a mental health facility, but none of this was reported through the database.

"Unfortunately it looks like the Air Force did not share that information and put it into the database," McCaul said. "I do commend the Air Force for starting this investigation but it may be the tip of the iceberg. How many other offenses are out there that aren't in the database that could prevent this kind of tragedy from happening again?"

The FBI also is working to unlock Kelley's cell phone, which is encrypted in the same manner as the phones used by the San Bernardino terrorist.

"The result in that case was hiring an Israeli defense contractor to get into the phone and the larger question of encryption. Terrorists and criminals can use encrypted [messages] to communicate and we can't see those communications in advance. As a former federal prosecutor if you can't see what they are saying in advance, even if you have a wire type or FISA you can't stop that act from occurring."

McCaul said there will be hearings to determine exactly what happened in connection with Kelley's ability to get weapons.

"Not only do we have 26 people murdered and children killed, but the fact that it could have possibly been stopped makes it even harder to accept, so I can assure you that Congress will be holding oversight hearings on this," McCaul said.
