Ted Cruz on Supreme Court: 'Everybody Has Changed Their Position'

Sen. Ted Cruz, R-Texas, on Tuesday defended Republicans against charges of hypocrisy over making a Supreme Court nomination in an election year, saying “everybody has changed their position” on the issue.

“Every Democrat has flipped,” he told CBS’ “This Morning” on Tuesday. “There's a reason for that. Both sides believe something fundamentally different about Supreme Court justices. The Democrats and [former Vice President] Joe Biden have promised to nominate liberal activist judges.”

He added that since Republicans won control of the Senate and the White House, President Donald Trump has the voters’ approval to nominate a conservative judge.

“President Trump ran promising to nominate principled constitutionalists to the court. The American people elected him. The American people elected a Republican majority three times in 2014, 2016, 2018. The Republican majority in the Senate ran promising to confirm constitutionalist judges,” Cruz said.

The senator previously opposed rushing to fill a Supreme Court seat, issuing a press release after the death of Justice Antonin Scalia saying: "I proudly stand with my Republican colleagues in our shared belief - our advice and consent - that we should not vote on any nominee until the next president is sworn into office ... The People will decide. I commend Mitch McConnell and Chuck Grassley for holding the line and ensuring that We the People get to exercise our authority to decide the direction of the Supreme Court and the Bill of Rights."
