Sen. Cruz: GOP Will Continue to Protect Preexisting Conditions

Republican lawmakers will protect Americans with preexisting conditions even if the Supreme Court rules that the Affordable Care Act is not constitutional, Sen. Ted Cruz said Monday. 

"Every Republican agrees we’re going to protect preexisting conditions," the Texas Republican said on CNBC's "Squawk Box." "What they’re talking about is what they think politically resonates, but 100 out of 100 senators agree we’re going to protect preexisting conditions regardless of what happens with Obamacare." 

The court is to hear the latest legal challenge to the ACA, also known as Obamacare, on Nov. 10, by which time President Donald Trump's nominee, Amy Coney Barrett, may or may not have been confirmed to succeed late Justice Ruth Bader Ginsburg. 

Democrats say that if Barrett is confirmed to the court, that will swing its majority to 6-3 for conservatives. The court will be arguing the California v. Texas case on challenging the minimum coverage provision of the ACA. 

Cruz also on Monday warned that Democrats could cause some violent swings in the economy if their nominee Joe Biden wins and their party takes control of the Senate.
"They will end the filibuster they were going to do that long before the Supreme Court vacancy," said the senator. "They'll do that because they want to ram through some policies that from the business community will be enormously damaging."

Democrats also want to repeal Trump's tax cut from three years ago that helped produce an "incredible economic boom" and raise taxes nationwide at a time when the nation is coming out of "essentially a depression," said Cruz. 

"They're looking to impose massive new regulations," he continued. "The 'Green New Deal' is going to cost $93 trillion, which to put it in context is more money than the federal government has spent in the entire history of the United States of America."

The Democrats' energy policies will also destroy the nation's oil and gas industry and energy production, said Cruz, and he thinks there's a "real risk" they will pack the Supreme Court with justices that "are just going to do whatever they happen to think is fair and good policy."
