Sen. Hawley Blasts Dems Threat to Pack Court Over SCOTUS Fight

Sen. Josh Hawley said he hopes American voters are “listening carefully” to Democrat lawmakers who are threatening to “burn down the Constitution” and pack the courts if the GOP-controlled Senate confirms a Supreme Court justice ahead of the election.

During a Monday appearance on Fox News’ “Fox & Friends,” the Republican lawmaker from Missouri said Democrats will be able to “confirm and nominate their own justices in the future.”

He noted that Democrats lost the 2016 election and called their threats of breaking “all of our Constitutional norms and standards” by packing the courts or "conducting impeachment hearings to stop a president from carrying forward his Constitutionally authorized privileges and responsibilities” as “insane.”

“If he holds a vote in 2020, we pack the court in 2021,” Rep. Joe Kennedy III, D-Mass., tweeted on Saturday about the Republicans' plans to fill the seat held by Justice Ruth Bader Ginsburg, who died on Friday. “It’s that simple.”

Kennedy was referring to Senate Majority Leader Mitch McConnell who promised to hold a vote to confirm Trump's nominee. 

The high court has ruled that “packing” the court with extra justices is unconstitutional. It was attempted unsuccessfully by President Franklin Delano Roosevelt in 1937.

Now, it seems like the attempt to add more justices to the bench is gaining support among Democrats if they take over the White House and Senate in the upcoming election.

“Mitch McConnell set the precedent. No Supreme Court vacancies filled in an election year. If he violates it, when Democrats control the Senate in the next Congress, we must abolish the filibuster and expand the Supreme Court,” Sen. Ed Markey, D-Mass., tweeted.

Markey called out McConnell who blocked President Barack Obama’s nominee Merrick Garland after conservative Justice Antonin Scalia died on Feb. 13, 2016 because it was an election year.

Trump said he will announce his pick on Friday or Saturday.

Hawley said that he “hopes” American voters are paying attention to what Democrat lawmakers are saying.

“This is the same party that looks away while rioters and looters burn down our towns. Now, the Democrats are saying they’ll burn down the Constitution. These people should not be in power.”
