Rubio: Dems Have Always Aimed To Stack Supreme Court

Sen. Marco Rubio, R-Fla., said Democrats have long aimed to stack the Supreme Court — and he’s been anticipating they’ll do it again this year.

In an interview last Wednesday on Sinclair Broadcasting’s “America This Week,” Rubio noted six months ago, he introduced a constitutional amendment to lock in the number of Supreme Court justices at nine.

"They've been saying it for a long time,” he said of Democrats’ intentions to expand the number of justices on the high court.

“In essence, they're threatening to do what they've already threatened to do."

Rubio also said there’s “no legal issue” and “no constitutional issue” if  Senate Republicans move ahead to confirm Trump's Supreme Court nominee.

"The president is allowed to nominate whenever he wants up until the last day of his term and the Senate is allowed to move on it whenever they want,” he said, adding that in 2016, there was “no legal obligation” to give then-President Barack Obama’s pick, Judge Merrick Garland, a hearing.
