Sen. Blumenthal: President Can Be Indicted, 'No One Is Above the Law'

Sen. Richard Blumenthal, D-Conn., said that while there was no precedent for indicting a sitting president of the United States, he believes it can be done.

"It has never been tested in court. There is no precedent for it," Blumenthal said Thursday on CNN'S "New Day" program.

"I will grant you that there are a lot of legal scholars who say that a president cannot be indicted while in office. I happen to believe, having reviewed a lot of the same law, that a president can be indicted. Why? Because no one is above the law."

A president could be indicted but not set up for trial while in office, Blumenthal said.

"The president has profoundly important duties of office. But those responsibilities can be reconciled with an indictment and a delay of the trial until he is out of office. The danger with putting him above the law is that the statue of limitations can run, a potential criminal liability may be lost," Blumenthal said.

"That's why I think that an indictment, but not a trial, is the right way to go," he added.

The congressman also commented on statements from Rudy Giuliani, in which Giuliani, a member of President Donald Trump's legal team, had said that Mueller's team told Trump's team that he would not indict a sitting president per Justice Department rules.

"When Robert Mueller is ready to announce his own conclusion about whether a sitting United States president can be indicted, I think he will do it for himself, not through Rudy Giuliani. I'm sort of dubious that the special counsel has articulated this position through former mayor Giuliani," Blumenthal said.

The former mayor made the comments to CNN's Dana Bash Wednesday.
