Neal Katyal, who served as acting solicitor general for President Barack Obama, will introduce President Donald Trump's nominee to the Supreme Court Neil Gorsuch, a move that highlights a dilemma for Democrats, CNN reported.

The introduction will come before Gorsuch delivers his opening testimony to the Senate Judiciary Committee for his confirmation hearing on Monday.

Democrats remain outraged that Republicans blocked Obama's pick, Merrick Garland, without even a hearing, after he was nominated last March, contending that the seat was stolen.

However, they also concede that Gorsuch is highly qualified for the position, and many say they should conserve their political capital for a potential future Supreme Court pick by Trump that is not replacing a conservative jurist.

Katyal argued in a column for The New York Times in January that Gorsuch "brings a sense of fairness and decency to the job, and a temperament that suits the nation's highest court," stressing that he believes this, "even though we come from different sides of the political spectrum."

Katyal acknowledged that the GOP's obstruction on Garland, "perhaps the most qualified nominee ever for the high court," was unfair, but stated that "if the Senate is to confirm anyone, Judge Gorsuch… should be at the top of the list."

He emphasized that a major consideration was that Gorsuch would help to restore confidence in the rule of law, because "his years on the bench reveal a commitment to judicial independence — a record that should give the American people confidence that he will not compromise principle to favor the president who appointed him."

Some liberals have criticized Katyal for his support. Alliance for Justice President Nan Aron told CNN that many in "the elite legal class…. are too impressed by Gorsuch's personal polish and resume to see past them to how damaging his record is when it comes to the impact on everyday people."
