Norm Eisen, President Barack Obama’s top White House ethics lawyer, believes former FBI Director James Comey might actually win if he files a libel lawsuit against President Donald Trump.
Eisen’s comments came in a Monday tweet and noted Trump’s accusations of criminal conduct against Comey could be a problem for the president.
"This false, malicious accusation of criminal conduct is libel per se by Trump. @Comey could sue—& might win. Despite absolute official immunity, open legal question whether defamation using personal Twitter may be outside its scope. See Nixon v Fitzgerald."
Trump has called Comey a "leaker and liar" and said he "should be prosecuted" for leaking classified information.
On Monday, he tweeted that Comey, fired deputy FBI director Andrew McCabe and others "committed many crimes."
Comey was interviewed by ABC News on Sunday and claimed Trump is "morally unfit to be president." The ousted FBI director’s book, "A Higher Loyalty," is due to be released on Tuesday.
