As the new Supreme Court term begins Tuesday, liberal focus is on Justice Anthony Kennedy, who could be set to retire after this year, according to CNN.

Sources have told CNN since last summer that Kennedy, age 81, is considering retirement.

Liberals say that they hope Kennedy keeps in mind that President Donald Trump could shift the ideology of the court to the right with Kennedy's replacement.

"I think Justice Kennedy has got to feel very uncomfortable about the drastic shift to the right that would take place on the court if he steps down and lets Trump pick his replacement," said Michele Jawando, an attorney for the liberal Center for American Progress.

"Justice Kennedy is one of the last things standing between progressive values rooted in the Constitution and the wrecking ball that is this erratic administration," Jawando said, according to CNN.

Kennedy has voted with conservative justices on campaign finance, gun rights, and voting rights, and he also has supported liberal-leaning issues such as LGBT rights, abortion restrictions, and affirmative action.

"Another Trump nominee would surely undo Kennedy's powerful legacy that includes protecting abortion rights and recognizing marriage equality for same-sex couples," Jawando said.

Constitutional scholar Erwin Chemerinsky said last summer that he had "no doubt" that abortion's legality could be reversed if a Trump nominee replaced Kennedy, or fellow justices Ruth Bader Ginsburg or Stephen Beyer, according to CNN.

Kennedy's stances could be tested in the case of a baker who refuse to bake a cake for a same-sex couple. "One the one hand, he has been one of the court's leading voices for LGBT rights and same-sex marriage. But at the same time, he takes a very expansive view of the First Amendment protection and the importance of expression to individual liberty and human dignity," said lawyer Yaakov Roth.

The justice could represent a deciding vote regarding gerrymandering — whether state lawmakers can arrange election districts to benefit their own party, according to USA Today.
