The Trump administration has shelved its efforts to fill the vacant associate attorney general post, the No. 3 job in the Justice Department, The Wall Street Journal reported.

The main reason: They can't find anyone who wants the job, the WSJ reported.

The AAG reports into Deputy Attorney General Rod Rosenstein, No. 2 in the DOJ hierarchy and the one in charge of oversight of the special counsel Russia investigation, a job that would fall to the No. 3 if Rosenstein were to resign or get fired.

Former AAG Rachel Brand left in February to take a job at Walmart. Jesse Panuccio has been acting AAG since then.

Difficulties abound in finding someone to take the job:

  • The possibility of getting stuck with oversight of the Mueller probe.
  • President Donald Trump's frequent and virulent attacks on the DOJ and, especially, AG Jeff Sessions.
  • Senate confirmation hearings.
  • A slew of vacancies at the DOJ that would report into the AAG.

Four of the five posts that report into the AAG on the org chart are also vacant, including the civil division and the tax division.

Labor attorney Eric Dreiband has been tapped by Trump to lead the vacant civil rights division but he is awaiting a Senate vote amid backlash from civil rights groups over his history defending corporations against discrimination cases.
