The Public Interest Legal Foundation has sent letters to the Department of Justice Civil Rights Division calling for the prosecution of those involved in the mob attack last week against a Donald Trump voter in Chicago.

One letter called for an investigation into the beating of David Wilcox as a violation of the Voting Rights Act of 1965, which prohibits intimidation of those who voted. Another letter calls for federal civil rights prosecutions of the perpetrators, because violence against individuals for exercising federal rights is prohibited.

The Chicago Tribune reported that video captured the mob attack on Wilcox in which he was beaten and kicked as bystanders cheered on with calls of "beat his ass, he voted for Trump" and "it’s one of them white boy Trump guys."

Wilcox said he did vote for Trump, but that the mob would have no way of knowing that.

Police said they were investigating the beating and who made the "politically divisive" statements in the video. Although no one yet has been brought into custody, the police insists that they are "taking this very seriously, and that type of divisive rhetoric is not acceptable."

Wilcox said the incident started when a car grazed his vehicle and, after he got out to exchange insurance policies, a group of five people started beating him. As Wilcox tried to get back in the car, someone else sat down in the driver’s seat and drove away, dragging Wilcox along holding onto the car until he fell off.

The Public Interest Legal Foundation charged "that the Department [of Justice] has different standards for enforcing the law depending on the nature of the victim and the nature of the perpetrators."

Breitbart reported that a comparison is then made to the Department of Justice probe that was made into the Ferguson, Missouri altercation between Michael Brown, who was black, and white police officer Darren Wilson.
