Former FBI director James Comey, ex-deputy director Andrew McCabe, and former special agent Peter Strzok are likely to be investigated in the wake of the fallout over how the Russia probe was handled, Fox News legal analyst Gregg Jarrett said.
Jarrett made his comments Thursday night during an interview with Fox News' Sean Hannity.
"The three people who would surely at the top of the investigative microscope list would be James Comey, Andrew McCabe, and Peter Strzok," he said. "I think there are three distinct areas that the U.S. Attorney John Durham and [Attorney General] William Barr are looking at: that would be lying to the FISA court, the [Michael] Flynn case to be sure, and the overall collusion investigation, how it was handled by the FBI and federal prosecutors.
"I think we need to be reminded of what William Barr said. This was an investigation launched by the FBI without a legal basis and later used it to sabotage the Trump presidency. The following federal criminal statutes would be in play: Obstruction of justice, perjury, fraud, conspiracy to commit fraud, and deprivation of rights under color of law, otherwise known as an abuse of power."
Jarrett's remarks came after the Justice Department announced it was dropping charges against Flynn, the former national security adviser. Prosecutors had claimed Flynn lied to the FBI about his conversations with the Russia ambassador during a January 2017 interview.
But the Justice Department said Thursday it found Flynn's interview by the FBI "unjustified."
