GOP Sens Hoping Justice Kennedy Retires Before Midterms

Republicans in the Senate privately admit they are hoping Supreme Court Justice Anthony Kennedy announces his retirement before the fall midterm elections, The Hill reports.

The GOP lawmakers say a vacancy on the high court would help solidify their base as they try to maintain their majority in the Senate, the website noted.

There has been steady speculation about Kennedy's continued tenure on the bench, although he has not indicated any plans to retire. Kennedy, 81, was nominated for the Supreme Court by President Ronald Reagan.

One unnamed GOP senator told the Hill a Kennedy retirement would remind voters of the importance of keeping a Republican majority in the Senate.

"The only reason we won the White House and kept the Senate was because of that open Supreme Court seat," the lawmaker said, referring to the vacancy created by Justice Antonin Scalia's death.

President Donald Trump ended up getting his nomination of Neil Gorsuch confirmed to replace Scalia — convincing many he would act to make the Supreme Court more conservative, the Hill reported.

And another GOP senator said confirming one more conservative to the high court would give Republicans something to rally their base heading into the midterms.

"It would be helpful if he made this the cap of his career," the lawmaker said of Kennedy. "It would be very helpful to appoint another Neil Gorsuch on the court for the next decade."

Meanwhile, Nevada Republican Sen. Dean Heller has predicted Kennedy will retire this summer, according to Politico.

"Kennedy is going to retire around sometime early summer," Heller said.

"Which I'm hoping will get our base a little motivated because right now they're not very motivated. But I think a new Supreme Court justice will get them motivated."

And The New York Times reported in February that rumors Kennedy may retire were sweeping Washington.

The newspaper noted justices usually prefer to retire when the sitting president is of the same party as the one who nominated them to the high court in the first place.
