Alabama Republican Senate candidate Roy Moore is disqualified from serving not because of the sexual misconduct allegations leveled at him but because of his history of being removed from the bench, political commentator George Will said.

"The charges of sexual predation are distracting us from something that happened earlier — that this is a man who has twice been thrown off the bench in Alabama for his dislike of the American Constitution, his refusal to … well, actually the theocratic position that his religious conscience trumps the Constitution," Will said during a Thursday appearance on MSNBC's "Morning Joe."

"Now, that disqualifies him surely from taking the oath that they take when they pledge to support and defend the Constitution of the United States. But now we've forgotten about all that — we've forgotten that before the questions of his predatory sexual behavior came up, he was disqualified."

Several women have accused Moore of sexual misconduct, with most of the alleged incidents occurring roughly 40 years ago. He has vowed to remain in the race ahead of Tuesday's special election against Democrat Doug Jones, and polls show Moore has a slim lead.

Moore has twice served as Alabama Chief Justice. He was removed from office in 2003 over his refusal to move a Ten Commandments monument he commissioned from the Alabama Supreme Court building.

After winning re-election in 2013, Moore was suspended in 2016 and later resigned in early 2017 over his opposition to allowing same-sex marriages to take place in Alabama.
