The Supreme Court is the only federal court in the land that doesn't have a formal code of conduct for its justices, notable because the High Court has an ethics problem, Sen. Elizabeth Warren wrote in a column for Politico.

Supreme Court justices aren't bound by the Code of Conduct for United States Judges, given that the High Court was established by the Constitution, not by Congress. So justices may consult the code, but their decision to abide by it is voluntary, and Warren takes issue with that.

"When an ethical cloud hangs over the court, its fundamental integrity is compromised. At a time when Gallup polls have found that fewer than half of Americans approve of the way the court is handling its job, the justices ought to be making every effort to show that their personal integrity is above reproach," Warren writes.

Warren cites Justice Neil Gorsuch giving a speech to a group that had a stake in a Supreme Court case, and three justices — including Chief Justice John Roberts — who own shares in 53 publicly traded companies as examples of ethical issues that mar the credibility of the court.

Warren's out to change that, co-sponsoring a bill — the Supreme Court Ethics Act — that would compel the "Supreme Court to adopt an ethical code."

"It is time to begin rebuilding American's confidence in the court by establishing a formal code of conduct," Warren wrote.

"The Supreme Court has an even greater duty to set the example for courts around the country and demonstrate that its decisions are based on a fair and unbiased assessment of the facts and the law, not personal biases or their own financial interests.

"Eliminating ethical questions and conflicts of interests should be the starting point," Warren wrote.
