Rep. Collins: Amendment Will Stop Dems From Packing Supreme Court

Rep. Doug Collins said Tuesday he plans to introduce a constitutional amendment against packing the Supreme Court that will prohibit changing the size of the court until 10 years after any legislation is enacted to change the number of its seats.

“So what we’re going to say is this: If you want to pack the court, like Jerry Nadler, the chairman of the Judiciary Committee said and others have said, then we want to put a constitutional amendment that says 'let's take the heat of the moment out of this,'" the Georgia Republican said on Fox News' "Fox and Friends."

The move would "take the heat of the moment" out of any decisions on the court size, said Collins.

Rep. Nadler, D-N.Y., said over the weekend that if a lame-duck Senate approves President Donald Trump's pick to succeed late Justice Ruth Bader Ginsburg, the incoming Senate should act "immediately" to expand the court. 

"Democrats just want to change the rules if they don't get what they want," Collins said Tuesday, warning that packing the court could diminish its integrity. 

“We saw it during the sham impeachment,” he added. “We saw it during everything on the House side especially, and now it’s looking like the Senate is wanting to join in with it. They just want to change the rules if they don't get what they want.”

President Donald Trump told Fox News Monday that the confirmation for his pick should be finished before Election Day. He plans to announce his choice on Saturday.

Collins said his legislation will keep the court from immediately expanding if Democrats are able to get a constitutional amendment approved, so if Democrats are "really serious about this" and find they have reason to expand the court "beyond your momentary temper tantrum," the legislation won't take effect immediately.

"What we need to do is take the emotion out of this," said Collins.
