Democratic senators vowing to challenge Judge Neil Gorsuch nomination for the Supreme Court are some of the same who have already approved him for a lifetime appointment to the 10th Circuit Court of Appeals in July 2006, Fox News reported.

Among the notable Judge Gorsuch critics from the left include Senate Minority Leader Chuck Schumer, D-N.Y., and Sen. Ron Wyden, D-Ore., both of whom were a part of the Senate which confirmed Gorsuch 10 years ago in a 95-0 vote.

Not one opposing vote and just five abstentions.

Also in that Senate were:

  • President Barack Obama, D-Ill.
  • Vice President Joe Biden, D-Del.
  • Secretary of State Hillary Clinton, D-N.Y.
  • Secretary of State John Kerry, D-Mass.

Current senators who also served during that vote, according to the report:

  • Sen. Schumer, D-N.Y.
  • Sen. Wyden, D-Ore.
  • Sen. Dianne Feinstein, D-Calif.
  • Sen. Patrick Leahy, D-Vt.
  • Sen. Patty Murray, D-Wash.
  • Sen. Dick Durbin, D-Ill.
  • Sen. Jack Reed, D-R.I.
  • Sen. Bill Nelson, D-Fla.
  • Sen. Tom Carper, D-Del.
  • Sen. Debbie Stabenow, D-Mich.
  • Sen. Maria Cantwell, D-Wash.
  • Sen. Bob Menendez, D-N.J.

None of those individuals cast a dissenting vote against Judge Gorsuch. Among them, only Sen. Leahy and Sen. Wyden submitted questions for the confirmation proceedings, according to Fox News.

The Democrats' reasoning for blocking Gorsuch will have to be on the merits of his decisions on the bench since 2006 — otherwise, they might be exposed for obstructionist partisan politics, merely opposing him because former President Obama's nominee last year, Merrick Garland, was held from a Senate hearing by GOP senators because it was an election year.

"He's a widely respected jurist who deserves the nomination to be voted upon," White House press secretary Sean Spicer said.
