Rubio Criticizes California, Oakland Mayor for Actions on Immigration

California should not be defying the federal courts or federal laws on immigration, Sen. Marco Rubio said Friday.

"If you don't agree with federal law, that's why we have elections, that's why we have a Congress, that's why we have a federal court system," the Florida Republican told Fox News' "America's Newsroom.

He also criticized Oakland Mayor Libby Schaaf for tipping off people in her region about federal immigration arrests.

"You have a state that's openly invites [immigrants] into their jurisdiction," said Rubio. "That's in violation of the law, no matter how you feel about immigration, that's not legal and right. We all wish it wasn't headed in this direction, but we have to separate the two things. You may feel very strongly about an issue, but breaking the law in order to achieve it, in this issue, is not the right thing to do."

Meanwhile, Congress has not yet taken action on the Deferred Action for Childhood Arrivals program, and Rubio thinks senators who voted down President Donald Trump's deal on legalizing 1.8 million people through a pathway to citizenship would have voted for it just nine months ago.

"In the meantime, we are involved on a Senate bill to deal with small banks that are being wiped out by Dodd-Frank, and it's bipartisan," he said. "We will get that done and see what comes up next."

Rubio also on Friday discussed a bipartisan bill he and Democratic Florida Sen. Bill Nelson are sponsoring to encourage states to adopt "red flag" gun laws.

The bill, if passed, will creates federal grants to allow authorities to present judges with clear evidence that a person is dangerous, in order to keep them from buying guns and to seize the ones they already have.

Such a law could have prevented accused Parkland, Florida school shooter Nikolas Cruz from his actions in February, said Rubio.

"The people who called the sheriff's office on the FBI hotline could have instead gone to court ... the judge could have issued an order to take away those guns and stopped him from buying new ones," said Rubio. "That could have prevented him, which is in my mind the best way to stop these things, stop the shooter and killer before they even step foot in a school or a mall or a movie theater or anywhere else."
