Andrew McCarthy: Rosenstein a 'Typical Washington Creature'

Former federal prosecutor Andrew McCarthy ripped former Deputy Attorney General Rod Rosenstein, calling him a “weasel” during a Friday interview.

In an appearance on the "Daily" Daily Caller Podcast, the Fox News contributor told podcast host Derek Hunter that Rosenstein is a “typical Washington creature” who knows how to play the game.

Rosenstein testified before a Senate Judiciary Committee investigating the origins of a probe into the 2016 Trump presidential campaign and alleged Russia interference. Rosenstein appointed Robert Mueller as special counsel to look into the alleged interference. Rosenstein also wrote the “scope memo,” which outlined Mueller's authority for the investigation.

McCarthy said Rosenstein knew how to be involved without leaving his fingerprints on anything, which he said was evident in his recent testimony.

He said he wouldn’t call him “grossly incompetent or classify him as a “mastermind.”

“I think he is a typical Washington creature who understands how the game is played and how you sort of rise to the next level of authority by being involved in things, but managing always to never to have your hands or fingerprints culpably on them,” he said.

He said Rosenstein was able to be involved in the Russia probe, but claim he wasn’t responsible for the fall out of it. 

Because the investigation dealt with counterintelligence powers, which are secretly guarded, McCarthy said Rosenstein was in an environment that “allowed him to thrive.”

“There are all kinds of things you can do that are bad when you don’t think anyone is going to check your work,” he said.

McCarthy also discussed Minnesota Attorney General Keith Ellison’s decision to up the charges against the police officers involved in the death of George Floyd. He also expressed concerns over Ellison’s abilities to handle the case.

The attorney general has been under pressure to increase the charges. People have been protesting across the country.

“He has both undercharged and overcharged the case,” McCarthy said.

Originally, the officer who was responsible for Floyd’s death was charged with third-degree murder and manslaughter. Now, he faces second-degree murder charges.

The other officers involved in the incident have been charged with aiding and abetting murder.

McCarthy said he is worried the charges filed aren’t the right ones to fit the details of the incident. He said just because the charge sounds more serious, doesn’t mean it actually is.

“You have to read what the statute warrants,” he said.

He said the other officers involved in the arrest should have been charged with manslaughter, not aiding and abetting. He added that one of the officers shouldn’t face charges at all based on an incident report that doesn’t include details of his actions. 

“I’m worried that you are going to get acquittals in the case," he said, adding "it is a case that should result in convictions."
