Court: Gov't Can't Stop Illegal Minors From Having Abortions While in Custody

A federal panel of judges ruled Friday that the Trump administration cannot prevent undocumented teenagers from obtaining abortions while in federal custody.

As BuzzFeed News reported, the D.C. Circuit Court of Appeals handed down the decision via an 81-page opinion.

"The Supreme Court 'has determined and then redetermined that the Constitution offers basic protection to the woman's right to choose,'" the opinion reads. "And we are not free to dilute a constitutional right recognized by controlling Supreme Court precedent — a right the government affirmatively assumes unaccompanied minors here have — so that others will be dissuaded from seeking a better life in this country."

The case began in October 2017 when a pregnant teenager was detained after illegally crossing into the United States. She wanted to have an abortion while in custody, which the government refused to allow.

The girl was eventually released, which allowed her the opportunity to have an abortion outside the government's grasp. The case, however, has been in the court system ever since.

"A state could not ban abortions outright on the theory that pregnant women can just go elsewhere," Friday's opinion reads. "And the federal government has no greater leeway to ban abortions on the theory that pregnant women can go elsewhere via voluntary departure."

Several states have recently enacted laws that made abortion illegal in some or all forms, going against the 1973 Supreme Court case Roe v. Wade that legalized abortion nationwide.
