Fox Legal Analyst Wiehl: High Court Will Skirt Tough Issues

The U.S. Supreme Court will ultimately wiggle out of deciding on the issues of gay marriage and whether the government should fund birth control, Fox News legal analyst Lis Wiehl says.

"They're going to find some kind of technicality so they don't have to reach the huge, major constitutional issue," Wiehl, author of the new thriller "Snapshot," told "The Steve Malzberg Show" on Newsmax TV.

"They'll find these technicalities, whether it's in the state law or some kind of thing that's happened as it's gone up the federal system . . . You want them to say, yea or nay . . . They're not going to get that far," she said Tuesday.

Wiehl says the Supreme Court can get out of making any kind of constitutional ruling by saying it's a state issue.

"[They'll say] it was not resolved correctly at the state, or it wasn't resolved and go back to the state and resolve it there," she said.

"That just seems to be the trend in the last few years of let's avoid the constitutional issue, let's just punt it back to the states."
