Trey Trainor to Newsmax TV: Harris May Have Committed Crime in Cleveland

Trey Trainor, Chair of the Federal Election Commission, in an interview on Newsmax TV on Tuesday questioned whether Sen. Kamala Harris, D-Calif., the Democratic vice presidential candidate, was acting improperly while appearing in Ohio on Saturday.

Trainor told “The National Report" on Tuesday, after watching a clip of Harris speaking to a line of voters through a megaphone in Ohio, that electioneering is “trying to garner votes outside of a polling location while an election is taking place, while voting is actually taking place in a polling location. Most states have a distance marker, in some it’s as short as ten feet,” but “most have it at about a hundred-foot line and it usually is from the actual polling location itself, so, where the actual ballot is being cast, a hundred feet from there." 

He added that in the video clip, Harris is “clearly outside,” a polling location, but then said, “I can't tell in the video where exactly the polling location is to know where she is relation to that. But, if she is within the hundred feet then clearly she is electioneering … and in most states that would be a crime.”

According to a fact check by Euronews, Harris was standing at East 30th Street in Cleveland, which is at least 200 feet from the Cuyahoga County Board of Elections. A spokesperson for the CCBOE confirmed to Euronews that Harris “maintained at least a 10-foot distance from the electors in line to vote who were already beyond the 100 foot no campaigning zone.”

The spokesperson also noted that Harris did not solicit voters, and that “greeting voters is not considered campaigning.”
