Judicial Watch's Tom Fitton: Lawsuit About Obamacare Lies

Judicial Watch's lawsuit on behalf of former CBS journalist Sharyl Attkisson isn't about politics, its president, Tom Fitton, told Newsmax TV, but rather the government's "lies" about Obamacare and the failure of healthcare.gov.

"This is about a fundamental issue of the rule of law, of transparency and our government lying to us," Fitton told "America's Forum" host J.D. Hayworth Thursday.

Attkisson says the Centers for Medicare and Medicaid Services failed to respond to four Freedom of Information Act requests she had sent in October 2013 and on June 4, seeking information about enrollment numbers in the early days of healthcare.gov, and for allowing favored private interests, not journalists, to view the website's repair operations.

"They pretended, for instance, not to know or have no idea how many people were signing up and things like that," said Fitton. "That's simply not true and we want that information."

He also pointed out that e-mails have disappeared from a key official responsible for Obamacare, marking yet another instance of an Obama administration employee losing communications.

"This administration simply refuses to obey the Freedom of Information Act at its most basic level," said Fitton.

But there is not much outcry in Washington from the media because reporters play "the reporters games," said Fitton. "They cover the White House. They don't like to be walled off from getting in on what they think journalists ought to be covering."

Fitton said it does not appear that the material Attkisson was seeking was kept according to federal law.

"The problem is a transparency crisis that the reporters don't have any clue about," said Fitton.
