Yoo: 'Disorganized' Dems Talk More on Garland Than Gorsuch

Former Justice Department official John Yoo said he is surprised Democratic lawmakers are obsessing more about Merrick Garland, former President Barack Obama's Supreme Court pick, than they are about Neil Gorsuch, President Donald Trump's pick who is in his second day of confirmation hearings.

"I think Gorsuch looks confident, poised, knowledgeable – I'm actually kind of surprised at how disorganized, uncertain, and tentative the [Democrats] sound," Yoo, a former assistant attorney general under former George W. Bush, told Newsmax TV's "The Steve Malzberg Show."

"The Democrats are spending more time talking about how their guy, Merrick Garland, should have gotten a hearing a year ago, and they're spending less of their time actually focusing on the nominee who's sitting just a few feet in front of them.

"So, to me, it seems that the Democrats have already decided to throw in the towel in terms of really trying to stop him."

Yoo said Democratic lawmakers are only making "a show" out of opposing Gorsuch because they are getting "a lot of pressure from their base."

"It's incredible what groups are saying about Gorsuch," Yoo told Steve Malzberg. "I mean Gorsuch is a very sober judge. He's really never done anything wrong. He's been a great writer, and he's got very well thought-out views.

"You would think if you read the things that the left-wing groups are putting out, this is the second coming of the author of Dred Scott," he said, referring to the landmark Supreme Court decision in 1857 that declared "a negro, whose ancestors were imported into [the U.S.], and sold as slaves, whether enslaved or free, could not be an American citizen."

"The Democrats in the Senate, I think, are kind of making a show of opposition to placate these groups, but they have no substance to attack Gorsuch."

In March 2016, Obama nominated Garland to fill the late Antonin Scalia's seat, but the Senate Republicans refused to hold a hearing or vote on Garland, insisting the next elected president should fill the vacancy. Democrats have charged the GOP stole the Supreme Court seat.
