Dershowitz: Obama Releasing 6,000 Prisoners Just a Band-Aid

President Barack Obama was right to apologize to Doctors Without Borders Wednesday for the U.S. airstrike on its medical clinic in Afghanistan, "but the president also ought to apologize to Israel for too quickly condemning Israel when in the fog of war Israel may have done something much like that," retired Harvard law professor Alan Dershowitz told Newsmax TV.

"Remember, when you have terrorists who hide among civilians, it's going to be inevitable that there will be some civilian casualties," Dershowitz, who is now professor emeritus, told "Newsmax Prime" host J.D. Hayworth. "That's the nature of this kind of warfare. It's deliberate, done by the terrorists.

"They purposely hide among civilians in order to get democracies like the United States and Israel to defend them while trying to protect their soldiers.

"Inevitably, there are going to be some events like this — but apologies are appropriate as long as its coupled with corrective action to make sure it doesn't happen again if it can be stopped."

In his apology to the group's international president, Joanne Liu, Obama assured her that his administration would conduct a thorough investigation of the incident, White House spokesman Josh Earnest said.

"Even if they weren't hiding in or around the hospital, that's their tactic," Dershowitz told Hayworth about Islamic State terrorists who were targeted by the strikes. "They hide among civilians in order to induce fire at civilians.

"That's part of the tactic and strategy. We have to be smarter than they are."

Turning to Obama's plan to release as many as 6,000 federal nonviolent drug offenders from prison, Dershowitz called the move a "blunderbuss step," because it did not address the key issues of overcrowding and recidivism.

"We confine more people in prison than any Western democracy. We have far, far too many appeals, the sentences are far too long — and this is a Band-Aid to a very, very large problem.

"Inevitably among the thousands who are released, there are going to be some who will recidivate, and so there will be criticism for that," he added.

"When you have a large population, there will be some who will commit crimes again. It's not a risk-free process.

"On the other hand, there are so many people in prison today for sentences that are far too long in proportion to the crimes they've committed — particularly non-violent offenders, personal drug users, college kids who sold drugs, kids from the inner city who may be part of a drug culture.

Dershowitz is the author of the new book, "The Case Against the Iran Deal: How Can We Stop Iran From Getting Nukes?"
