Rep. Bill Flores Predicts Court to Rule Against Obamacare

After sitting in on the Supreme Court hearings challenging the Obamacare federal subsidies, Texas Rep. Bill Flores tells Newsmax that he predicts that the high court will rule against Obamacare in a tight decision.

"It looks to me like we’re going to have a 5-4 decision in all likelihood," the Texas Republican told J.D. Hayworth and Miranda Khan on "America's Forum" Friday on Newsmax TV.

"My gut tells me that the Supreme Court will rule the subsidies to be illegal, and therefore Obamacare will fail," he predicts.

Flores said he had the opportunity for the first time to "sit in the Supreme Court hearing," and that he was "fascinated by the arguments that were put forth by each side and also by how the justices reacted to the argument."

The Supreme Court heard arguments Wednesday in the Obamacare case, which is challenging a part of the law that says that subsidies are only supposed to be given to those who purchase health insurance through state exchanges, not the federal exchange.

If the Supreme Court does rule against Obamacare in this case, "some parts will stay in place, but I think overall, it will fail," he said.

However, the Texas Republican said that the "overarching goal" in Congress for Republicans "is to still repeal Obamacare, and now it looks like the Supreme Court may cause that to happen."

If that does happen, "Congress will have to look at a bridge to make sure that those folks don’t wind up in a gap."

Flores told Newsmax that there are several alternatives brewing in Congress that Republicans are working on.

"You have the chairs of [Education and the Work Force], Ways and Means, and Energy and Commerce in the House working on an alternative," he explained.

"The Republican Study Committee, which I lead, has a task force that’s led by [Reps.] Phil Roe from Tennessee and Austin Scott from Georgia that are working on a [Republican Study Committee] alternative as well," he said.

He explains that the RSC alternative has five themes: "No. 1 is it’s patient centered, and we’re trying to restore the patient-provider relationship and get all the friction of bureaucracy and insurance companies out of the middle of that relationship."

"It’s based on the free market. It’s based on giving states flexibility, and it’s based on transparency and increasing competition," he said.
