Andrew McCarthy: 'Odd Feeling' to Spy-Case Arrest

This week's arrest of a former CIA agent for having unauthorized classified information on undercover U.S. spies "has got an odd feeling all-around," former federal prosecutor Andrew McCarthy told Newsmax TV on Thursday.

"This thing is far from a slam dunk," McCarthy told "Newsmax Now" host Bill Tucker in an interview.

"We are talking about a man who served in the Army and CIA, retired in 2007 and was arrested in 2017 after an investigation in 2012 to 2013."

U.S. authorities arrested Hong Kong resident Jerry Chun Shing Lee, 53, late Monday after he arrived at JFK International Airport in New York.

The Justice Department said that in 2012, FBI agents with court-ordered warrants secretly searched Lee's luggage in the United States — finding that he carried top-secret materials he was not authorized to have.

The data included "true names and phone numbers of assets and covert CIA employees, operational notes from asset meetings, operational meeting locations and locations of covert facilities," the Justice Department said.

Lee, a naturalized US citizen also known as Zhen Cheng Li, grew up in the U.S. and served in the Army before joining the CIA in 1994.

He later served in various unnamed overseas locations before leaving the agency in 2007 and later apparently taking a job in Hong Kong.

Lee is charged with unlawful retention of national defense information, which carries a maximum 10-year prison term.

Authorities, however, have not yet explained the delay in charging Lee nor whether he had leaked information to foreign countries.

McCarthy told Tucker that, while the scope of the U.S. government's remained to be disclosed, "there's usually a lot of pressure to try to plead those out with the cooperation of the guy who's in their sights.

"You don't want to get the classified information into the public domain — and you want the guy's cooperation so you can make an assessment of how much damage they'd spend."
