Alan Dershowitz to Newsmax TV: Trump Needs 'Perfect Storm'

President Donald Trump's legal challenges have a narrow path to have the House state delegations decide the election, but it has to come through the courts and will require a "perfect storm," according to constitutional law expert Alan Dershowitz on Newsmax TV.

"It's a very uphill fight; you'd need a perfect storm for it to be achieved but legally, constitutionally, there is a route to that result," Dershowitz told "Saturday Report."

Dershowitz noted Trump's lawyers have a "winning legal theory," but they need to make the case it can be outcome determinative for the election – and that needs to happen in the courts and soon.

"America's getting somewhat skeptical, so they're waiting to see the evidence: Where's the beef? Where's the beef? Show me the money," Dershowitz told host Carl Higbie. "You know, the expressions from the movies and TV have a reality in lives, so it's time to put up at this point."

Also, Dershowitz noted, the court of public opinion has no sway like the true courts – and appealing to judges not juries, "because they're seeking injunctive relief, not damages" – but Dershowitz added, "don't make promises you can't keep."

"What the Trump team needs to do now is back up their allegations and rhetoric with hard evidence, with expert testimony about the computers, with expert testimony about backdating, about other kinds of allegations," Dershowitz continued. "Allegations without evidence are just fodder for media, media criticism or attacks.

"They need to present evidence in court, which then would get covered by the media. The focus should be getting the evidence to the court.

Rebuking the mocking and even intimidation of Trump's lawyers guiding the legal case, Dershowitz, a famed legal author and Harvard professor emeritus, released another book this week: "Cancel Culture: The Latest Attack on Free Speech and Due Process."
