Mississippi Senate Passes Legislation Banning Abortions Past 15 Weeks

The Mississippi state Senate on Tuesday passed a bill prohibiting abortions 15 weeks past pregnancy, making it the most restrictive abortion ban in the nation, the Clarion Ledger reports.

The bill, which passed the Senate, 35-14, and was previously passed by the House of Representatives, will be held for more debate before it is sent back to the House and on to Republican Gov. Phil Bryant, who is expected to sign it. Current state law bans abortions at 20 weeks after conception.

Opponents decried the bill as unconstitutional and Diane Derzis, owner of Mississippi's only abortion clinic, Jackson Women's Health Organization, told the Clarion Ledger she plans to sue.

"These groups are tossing anything and everything out there, anything that could start winding its way through the legal system because we're in a very fragile place right now," said Derzis. "Roe is clearly in danger and that's what they're preparing for … They hope by the time they get to the Supreme Court they will have changed the Supreme Court."

The Supreme Court's Roe v. Wade decision in 1973 affirmed a woman's right to abortion, and the 1992 Supreme Court case Planned Parenthood of Southeastern Pennsylvania v. Casey found states could not place an "undue burden" on women who wanted abortions.

Lt. Gov. Tate Reeves praised the legislation.

"Mississippians are committed to protecting the lives of unborn children, and this law will be a major step in accomplishing that goal," Reeves said in a statement. "I am committed to making Mississippi the safest place in America for an unborn child."
