Swalwell: Congress Has More Options on Mueller Now

Congress now has a "hell of a lot" more resources now than it did Monday if the Trump administration and newly named acting Attorney General Matt Whitaker move to end special counsel Robert Mueller's Russia investigation, Rep. Eric Swalwell said Thursday.

"We've won the majority in the House, so, the days of just looking the other way are over," the California Democrat told MSNBC's "Morning Joe." "So we can, you know, first pass legislation to protect Mueller, try and build momentum in the Senate, where they have already legislation out of the Judiciary Committee. We can insist documents be preserved and demand the recusal of Mr. Whitaker who has demonstrated a pretty clear conflict of interest."

Trump has made it clear, Swalwell said, that the only thing he cares about with the Justice Department and who runs it is "that person's position on his personal criminal exposure and that of his family in the Russia probe."

He added that Trump's main problem with Jeff Sessions, whose resignation the president eventually demanded, was because the former senator had recused himself from the Russia investigation, and not that he did "anything wrong or anything on immigration or national security or any other issue."

Instead, the congressman said, the fact Sessions "followed the rules and simply was not involved at all in overseeing the Mueller probe was grounds for this rather long-awaited firing, and all of the public berating that went along with it. So even if you fought following the Russia case day-to-day, that's pretty striking for an office to do when forcing our laws and dealing with national security."
