Matthew Whitaker to Newsmax TV: Roger Stone Deserves 'Lower Sentence'

Seven to nine years in prison would be an "extraordinary sentence" for what President Donald Trump's longtime ally Roger Stone did, but at the same time, he was convicted by a jury of his peers and should face some penalty, former Acting Attorney General Matthew Whitaker told Newsmax TV Tuesday.

"The question is, what's the appropriate sentence," Whitaker told "Newsmax Now" host John Bachman. "I think 7-9 years is too long, but you know, this is one of the things as a former prosecutor, I usually err on the side of more, not less. But at the same time, there are mitigating factors in this case that would suggest a lower sentence."

Earlier on Tuesday, Trump attacked the plan to sentence Stone to 7-9 years in prison, and later, the Department of Justice said a lower recommendation is being considered, pushing the four prosecutors who had worked on the trial to decide to step down.

Stone was convicted in November as part of a seven-count indictment that accused him of lying to Congress, obstructing the House investigation into whether the president's 2016 campaign coordinated with Russia, and tampering with a witness. He's set to be sentenced next week and is the sixth Trump advisor or aide to be convicted through special counsel Robert Mueller's investigation into Russian interference.

Trump on Tuesday declared on Twitter that the prosecutors' recommendation to sentence Stone to up to 9 years in prison is a "very horrible and unfair situation."

"He did take the government to trial, and he was resistant to any cooperation or any participation with the government to testify against others," said Whitaker. "The folks at main justice who supervise all prosecutors across the country did not agree and so this is where I think the prosecutors should have worked with the U.S. attorney to make sure everybody was on the same page."
