AG Garland: Special Counsel Report on Biden Classified Docs Going to WH, Congress, Then Public

Wednesday, 07 February 2024 07:13 PM EST

Special Counsel Robert Hur has completed his investigation into whether U.S. President Joe Biden mishandled classified documents during his time as vice president, Attorney General Merrick Garland said in a letter to Congress on Wednesday.

Garland said in the letter to House and Senate judiciary committee leaders that Hur had submitted his final report to the White House and Biden's personal lawyer to allow for comments and to review for executive privilege.

After the White House review, Garland said, the special counsel's report would be sent to Congress. Garland said he would make as much of the report public "as possible, consistent with legal requirements and Department policy."

The White House anticipates the privilege review of the report will be completed by the end of the week, White House spokesperson Ian Sams said.

A report in the Washington Post earlier this week quoted officials as saying that while Hur is critical of Biden's handling of classified materials, he and his aides aren't expected to bring criminal charges.

The probe focused on documents related to Biden's service as vice president to Democratic President Barack Obama from 2009-2017 and from his prior tenure in the U.S. Senate. They were found at Biden's home and former office.

Biden's lead rival in the November election, Republican former President Donald Trump, faces a 40-count federal indictment for retaining highly sensitive national security documents at his Florida resort after leaving office in 2021 and obstructing U.S. government efforts to retrieve them.

The Post, attempting to draw a distinction between the Biden case and Trump's, alleged significant differences.

The Post insisted there were significant differences between the Biden and Trump investigations.

It said the number of documents involved in the Biden case was fewer than 20 while the Trump probe involved roughly 300 found at his home.

Trump also has been accused of trying to mislead investigators while Biden was interviewed by Hur, the special counsel, in October along with dozens of current and former staffers, the newspaper said.

Trump and his allies have repeatedly insisted that the application of justice is unfair, and that Trump is being unfairly prosecuted while Biden is skating through.

"SELECTIVE PROSECUTION!!!!" Trump wrote on Truth Social in November, amid earlier reports Biden would likely not be charged.

Biden aides told the Post that the documents unintentionally ended up at his home and office because of "sloppy staff work."
