Deliberations in the federal corruption trial of Sen. Bob Menendez, D-N.J., will continue Monday after an alternate juror replaced one that was excused because of vacation plans, according to CNN. 

Prosecutors have accused Menendez in a bribery scheme in which he received gifts from a Florida ophthalmologist in exchange for political favors. Both Menendez and the ophthalmologist, Dr. Salomon Melgen, deny the charges, CNN reported.

Juror Evelyn Arroyo-Maultsby, who is leaving on vacation, told CNN and other outlets last week that the trial would end with a hung jury, saying that prosecutors "just didn't show enough, and I just wish I wasn't going on vacation. I would've been fighting in that jury room."

"You don't want this sort of feedback from someone who heard all of the evidence," said Lee Vartan, a former federal prosecutor, about Arroyo-Maultsby's comment, CNN reported.

If Judge William Walls formally declares a mistrial, the Justice Department could refile the charges, former federal prosecutors said in CNN's report.

"If you believed in the case enough to bring it in the first place, typically you bring it again," said Randall Eliason, George Washington University law professor, in CNN's report.

Democrats have not made clear what action they would take if Menendez is found guilty. The Democrats have 48 seats in the Senate compared to Republicans' 52.

"I don't know if we'd be in a hurry to get rid of Bob," one Senate Democrat told Politico.

New Jersey Gov. Chris Christie, a Republican, leaves office on Jan. 16, 2018. At that point, Republicans would no longer have leverage to push for Menendez to be removed, CNN reported.
