Former New York Times legal writer Linda Greenhouse said in a column published Thursday that the death of conservative Justice Antonin Scalia in February may well have been a good thing for America.

"Would it be unseemly to suggest that only Justice Scalia's death has preserved democracy in North Carolina?" Greenhouse wrote. "There, I just did."

Greenhouse was commenting on the Supreme Court's denial in August of a reinstatement of North Carolina's voter ID law, seen by the left as an attempt to suppress black voters.

"Had Justice Antonin Scalia been alive and voting, the state's motion would undoubtedly have been granted, giving North Carolina a green light to conduct the Nov. 8 election under a law that the appeals court found to have been devised 'with almost surgical precision' for the purpose of suppressing the African-American vote," Greenhouse wrote.

But Emily Zanotti, writing at Heat Street, said Greenhouse, who regularly sides with the left-leaning members of the court, is "stretching on the court's ruling."

"The Supreme Court merely approved an emergency stay on North Carolina's strict voter identification law, requiring voters to prove residency in the precinct before casting a ballot," Zanotti writes. "Because it was unlikely that plaintiffs suing the state would be able to get a full SCOTUS ruling on their appeal until 2017, the Court said the law should not impact the November 2016 Presidential election."

The high court has had only eight members since Scalia's death since the Republican-controlled Senate has said it will not consider President Barack Obama's nomination of Merrick Garland until after November's presidential election.
