When it comes to immigration, Gov. Greg Abbott, R-Texas, talks a big game.
He’s slammed President Joe Biden for failing to secure the border, vowing to step in where the federal government hasn't or won’t.
It’s true that the Biden administration's lack of action or any actual plan on the southern border is an absolute dereliction of duty.
In June, a Trafalgar/Convention of States poll found that a majority of Americans believe Biden’s border policies were driven primarily by politics, and just last month, a full 75% of Americans said that Vice President Kamala Harris has done a poor job managing the crisis,
But if we are to be intellectually honest about what is causing the problem, and how to fix it, then we must also look at Gov. Abbott’s actions.
Aside from bold statements — what, exactly, has Abbott done to stem the tide of illegal immigration? Not much. To borrow an often used saying in Texas, "Gov. Abbott is all hat, no cattle."
The mainstream media portrays Gov. Abbott as a racist immigration hawk because he says he doesn’t support Biden’s open border policies and has sent National Guard units to the border.
If journalists would do their jobs, they would know that the border leaks like a sieve.
Independent journalist Michael Yon is on the border, and he reports that the Texas National Guard is doing nothing to stop illegal immigration.
"Migrants cross the river right in front of us. Texas National Guard do nothing but wait for Border Patrol, but huge numbers avoid the National Guard completely. They are breaking into homes and destroying fences deep in the interior dozens of miles from the border," he reports.
A record number of immigrants have illegally crossed the southern border. Some of them are purpotedly criminals, cartel members, and drug runners. Others may well plan to leech off our economy, send their earnings home, then go back where they came from.
Some are fleeing poverty and want a better life, but even some of these men and women have no regard for our laws and deserve to face the consequences of their actions.
While Biden’s open-borders rhetoric and policies are the primary drivers of this crisis, Gov. Abbott has the legal authority to end this today — right now.
Art. IV, Sec 4, of the U.S. Constitution guarantees that the federal government will protect each state against "invasion." As constitutional scholar Prof. Rob Natelson has pointed out, the surge of illegal immigrants is exactly that.
But what can be done when you have a president like Biden who has shown no willingness to fulfill his constitutional duties?
Fortunately, in their wisdom, the Founders gave the states the authority to repel enemy invasions without authorization from Congress.
Art. I, Sec 10, Clause 3, of the U.S. Constitution prohibits states from engaging in war "unless actually invaded, or in such imminent Danger as will not admit of delay."
Furthermore, Art IV, Section 7, of the Texas State Constitution allows the governor to "call forth the militia to execute the laws of the State, to suppress insurrections, and to repel invasions."
In short, Texas is being invaded, and Abbott has the authority from both the state and federal constitutions to act. Not only does he have the support of the U.S. and Texas constitutions, he has the support of Americans.
In another recent Trafalgar/Convention of States national poll, 54.7% of American voters said President Biden should close the border until the immigration crisis is brought under control. That support would surely extend to Gov. Abbott if he chose to show leadership.
And yet, he refuses.
Instead of sitting in his office and blaming his problems on the president, Abbott should launch a whole-of-government campaign to end illegal immigration in the state of Texas.
As fomer-Congressman Lt. Col. Allen West — who is currently running in the Republican primary for Governor of Texas — has pointed out, the governor has many avenues to take action against the immigration crisis.
First, he should immediately send 5,000-7,000 National Guard troops to the border and instruct them to stop immigrants from moving through the major drug trafficking corridors.
No more standing around and waiting for the Border Patrol. The brave men and women of our National Guard signed up to protect our country from invasion — it’s time we let them fulfill their duty.
They don’t have to act alone. Abbott should also give Texas’ constitutional officers (sheriffs) the power to detain and deport.
Migrants are still going to slip through the border. Once they’re in the interior, we can’t rely on federal officials to send them back where they came from. We must block highways to anyone transporting illegal immigrants for any purpose, arrest those people, and deport them.
Next, Abbott should use his regulatory power to hamstring the cartels and NGOs enabling and profiting from the invasion of our country.
He can designate the cartels as "terrorists'' and go after their funding infrastructure.
And while he is at it Abbott should remove the licenses of any non-governmental organizations (NGOs) operating in Texas facilitating illegal immigration.
Lastly, Gov. Abbott can work with the Texas legislature in taxing remittances of any illegal immigrants sending money back to Central or South America in the amount of at least 10% (Oklahoma currently taxes immigrant remittances at 1%) to fund border control measures.
Here’s the bottom line: Abbott has full constitutional authority as the state’s military commander to take strong action to protect Texans, and other Americans, from the surge of immigrants flowing across our southern border.
If Abbott is the leader he wants us to believe he is, it’s time to stop talking and start doing.
The people of Texas will support him.
The American people will support him.
