Illegals Drive Up Healthcare Costs for Taxpayers in Massachusetts

Fraud in the Inducement is the legal phrase describing what occurs when a person enters into an agreement based on false information provided by a contractor. Have the hardworking taxpayers of Massachusetts and now of the entire United States been misled on affordable healthcare? If not, why are health insurance prices on the rise? The mounting number of illegal aliens on the healthcare dole may well be a factor.

In 2006, Massachusetts passed a healthcare program called MassHealth Limited, or Romneycare for then Gov. Mitt Romney, who signed the program into law. Over the past four years, MassHealth has proved to be a disaster. It mandates that all residents of Massachusetts purchase insurance plans that increase subsidies and eligibility for citizens and noncitizens alike, including illegal aliens. MassHealth creates managed competition requirements for insurance coverage and prohibits insurance companies from managing risks and costs.

As a result, the program’s cost-containment requirements are causing insurance companies to leave the field. Gov. Romney is wisely distancing himself from the evolving program.

MassHealth has failed to accomplish universal coverage. Insurance premiums are rising in the state, with taxpayers subject to “unexpected” costs in the millions of dollars.

A Boston Globe article on March 2, 2009, reported that although Massachusetts has been lauded for its healthcare reform, MassHealth fails in the following ways: It does not assure access to care, for instance, coverage is not continuous if a person changes jobs. It is not affordable for many individuals and families, and costs to Massachusetts have doubled and continue to increase annually.

MassHealth tends to reward people for working less and earning less, while its mandates result in employers dropping health insurance and placing employees on government-subsidized health programs.

Many families and small business owners are finding MassHealth a disaster. According to the non-partisan Galen Institute, the average health insurance costs for a family of four in Massachusetts now stand at $14,723, which is 12 percent higher than the national average. Illegal aliens in the state are a major part of the problem.

Current Massachusetts Gov. Deval Patrick admits their presence among MassHealth subscribers. In the first nine months of 2010, the estimated cost of MassHealth for “illegal immigrants” was placed at $33.8 million, with illegal aliens constituting 69 percent of all subscribers. In addition, an estimated 52,000 illegal aliens used free emergency room services at a cost of $35.7 million, funded by taxpayers.

Gov. Patrick, a confidant of President Barack Obama, may well be looking for a federal bailout to shore up the ailing MassHealth. Taxpayers in Massachusetts are paying the price for socialized medicine with high costs and poor service resulting from growing numbers of illegal aliens.

On November 16, 2010, Gov. Patrick announced his vision for the next four years, which includes further immigration-reform measures. These include drivers licenses for illegal aliens, in-state tuition for illegal alien students, increased public transportation and wage control for the benefit of illegal aliens, and other services to integrate illegal aliens into the life of Massachusetts.

Gov. Patrick seeks repeal of the federal Real Identification law of 2005 (REAL-ID) that requires strict criteria for driver’s licenses accepted for official federal purposes. He supports comprehensive immigration reform that would grant amnesty for all illegal aliens here now and in the future.

Meanwhile, taxpaying citizens are burdened with fines for not having healthcare insurance, even if laid-off from their jobs through no fault of their own. Massachusetts hires lawyers to enforce the MassHealth fines and penalties, thus taxpayers are paying for the lawyers who penalize them, all with the blessings of Gov. Patrick. MassHealth is punishing U.S. citizens while rewarding illegal aliens with free medical services.

Obamacare promises to effect the same disparities, favoring illegal aliens while penalizing taxpaying citizens. Current lawsuits by states across the nation question the constitutionality of Obamacare. On December 13, 2010, a U.S. District Judge in Virginia declared the Obamacare mandate requiring the purchase of health insurance to be unconstitutional.

On December 16, 2010, a case brought by 20 states attorneys general was argued in Federal Court in Pensacola, Florida. The Florida case is similar to the Virginia case but also attacks the expanded Medicaid requirements.

Who are the advocacy groups pushing MassHealth Limited and Obamacare (inappropriately named the Patient Protection and Affordable Care Act)?

Throughout the country, these experiments with socialized medicine are aided and abetted by radical Hispanic groups such as La Raza (The Race), leftist academicians, and liberal newsmedia financed by the likes of George Soros, the elitist billionaire who seeks to replace the U.S. democracy with an oligarchy — all the while keeping his own fortune off-shore for tax reasons.

Such purveyors of change, among them President Obama, are intent on transforming the demographics of the United States through open-borders immigration and re-distribution of wealth.

The November 2010 mid-term elections repudiated these changes being wrought in the United States.

Illegal aliens, however, continue to be told by advocates that they have a constitutional right to U.S. citizenship, that the Constitution is not an absolute document, that there are no absolute truths, only what one-worlders say is so.

Federal courts have the power to curb the open-borders and universal healthcare movements. The Founding Fathers provided for the separation of powers for just such a situation. The judicial branch of the government was established to step in when the executive or legislative branches exceed the articles of the Constitution.

Federal courts can yet rescue U.S. taxpayers from healthcare laws based on false information provided by government officials. Federal courts can come to the aid of the nation in this time of peril and declare Obamacare and state programs like MassHealth Limited unconstitutional. The separation of powers among legislative, executive, and judicial branches can yet save the Republic.
