Sofia Vergara Battles Ex Over Frozen Embryos

Sofía Vergara is locked in a very public battle with her ex-fiancé over the couple’s frozen embryos.

In an opinion piece published in The New York Times — headline “Our Frozen Embryos Have a Right to Live” — the “Modern Family” actress’s ex Nick Loeb reveals that he has filed a legal complain to protect two frozen embryos the couple conceived in 2013 through in vitro fertilization.

“We signed a form stating that any embryos created through the process could be brought to term only with both parties’ consent,” he writes. “The form did not specify — as California law requires — what would happen if we separated. I am asking to have it voided.”

He says that 10 other cases in the United States have involved a prospective parent’s wishes to have a fertilized, frozen embryo taken to term against the wishes of an opposing partner.

He adds: “When we create embryos for the purpose of life, should we not define them as life, rather than as property? Does one person’s desire to avoid biological parenthood (free of any legal obligations) outweigh another’s religious beliefs in the sanctity of life and desire to be a parent?

“A woman is entitled to bring a pregnancy to term even if the man objects. Shouldn’t a man who is willing to take on all parental responsibilities be similarly entitled to bring his embryos to term even if the woman objects?”

Loeb claims Vergara has refused his request to let him have them embryos even after he offered “to pay for all expenses to carry our girls to term and raise them….I would take on full parenting responsibilities and agree to have her declared an egg donor.”

The actress’s lawyer, Fred Silberberg, has told reporters that she wants to keep the embryos “frozen indefinitely.”
