NY Court Blocks Mandatory NYC Flu Vaccine Rule

A New York appeals court court has overturned a Bloomberg-era regulation requiring all children to obtain a flu shot in order to attend NYC preschools, daycare centers, or Head Start programs. 

The rule, which aimed to increase flu vaccination among children 6-59 months of age, was set to go into effect in Jan. 1, 2016, Activist.com reports.

In issuing the order, Judge Manuel J. Mendez said the New York State Supreme Court of Appeals determined NYC law "contains no suggestion that the Board of Health has the authority to create laws" concerning vaccination or other matters.
