Axios: Trump Bill Would Give Him Unilateral Power to Ignore WTO Rules

Draft legislation ordered by President Donald Trump would give him the power to raise tariffs at will, without congressional approval, Axios reported on Sunday.

Axios, which said it obtained a leaked draft of the bill, said the proposal would give Trump unilateral power to ignore fundamental rules of the World Trade Organization and negotiate one-on-one with any country.

A source familiar with the bill said "it would be the equivalent of walking away from the WTO and our commitments there without us actually notifying our withdrawal."

Trump was reportedly briefed on the draft in late May. Most officials involved in the bill's drafting, with the exception of hardline trade adviser Peter Navarro, think the bill is unrealistic or unworkable, with a source calling the proposal "insane" and adding that "Congress would never give this authority to the president."

In addition, the source insisted that the bill is "not implementable at the border … and would completely remove us from the set of global trade rules."

Legislative Affairs Director Marc Short told Navarro the proposal was "dead on arrival," as it would receive no support in Congress, according to sources, although Navarro insisted that the plan would receive plenty of backing.

White House spokeswoman Lindsay Walters said in response, "It is no secret that POTUS has had frustrations with the unfair imbalance of tariffs that put the U.S. at a disadvantage. He has asked his team to develop ideas to remedy this situation and create incentives for countries to lower their tariffs. The current system gives the U.S. no leverage and other countries no incentive."

However, she insisted that there is no actual legislation the administration is ready to propose, as "Principals have not even met to review any text of legislation on reciprocal trade."
