Utah Abortion Laws and How They Compare Nationally

Utah has restrictive laws covering abortion compared with the rest of the nation.

According to a study by the Guttmacher Institute, Utah ranked No. 2 behind Oklahoma in having the most restrictions of any state, The Washington Post reported. Oregon had the least.

The activist group NARAL Pro-Choice America gave Utah an F grade, noting on its survey of states that 97 percent of all Utah counties have no abortion clinic. NARAL also described the state's governor and both houses of its legislature as "anti-choice."

Utah has a 72-hour waiting period after a woman receives state-required counseling before undergoing an abortion, the Guttmacher Institute noted. Typically, most states with a waiting period require just 24 hours, making Utah's requirement more stringent.

Utah also requires parental consent for a minor to have the procedure (a judge can intervene on this), and parents must be told about the procedure 24 hours before it takes place. Public funds may only be used on abortions when a woman's life is endangered or in cases of incest or rape.

The anti-abortion group Americans United for Life ranks Utah at No. 29 nationally on its 2014 state report card. It noted that Utah also "requires that a woman seeking abortion at five-months or 20-weeks gestation or later be offered anesthesia for the unborn child (because of the pain experience by a child by this stage of development)."

In 2011, Utah had a total of nine abortion providers statewide, while in the same year there were 1,720 abortion providers total in the United States, Guttmacher noted. It added that 3,290 women received abortions in Utah in 2011, marking a rate of 5.4 abortions per 1,000 women of child-bearing age. Nationally, in that same year 1.1 million women in the United States had abortions, marking a rate of 16.9 abortions per 1,000 women of child-bearing age.
