Judge Napolitano: Sens Can't Be Expelled for Pre-office Behavior

Judge Andrew Napolitano on Wednesday said no senator has ever been expelled for behavior that took place before being elected to office.

In a spot on Fox Business' "Varney and Co.," Judge Nap addressed the growing allegations against Sen. Al Franken and the possible election of Roy Moore in Alabama.

"No senator has ever been expelled for behavior in which the senator engaged before the senator was in office," Napolitano said, though the range of allegations against Franken extend to 2010, two years after he was elected to the Senate.

A host of Democrats on Wednesday called on Franken to resign, but they would have a tough road to expel him, Napolitano said.

"This is the same thing that may confront the Senate if Roy Moore is elected," he said. "They cannot expel him for behavior that occurred before he was in the Senate without materially changing their rules and procedures."

However, "politically this is catastrophic for Senator Franken," he said.
