A federal judge said Texas is seeking to amend vital state records to recognize gay spouses on birth and death certificates, in order to comply with the U.S. Supreme Court’s decision legalizing gay marriage.

Texas “is working diligently to finalize policies that should prevent the recurrence of these issues in the future,” U.S. District Judge Orlando Garcia of San Antonio said in a court filing Monday. He postponed a contempt hearing on the matter.

Garcia gave the state until Sept. 10 to reach a “global resolution” of the issue, raised by several same-sex married couples seeking to amend official birth and death records. Paxton’s office confirmed the delay, declining further comment.

The judge had summoned Paxton to explain the state’s refusal to fully recognize gay marriages in the wake of the high court ruling in June. The attorney general faced a potential contempt citation.
