Report: White House Still Dragging Feet on ACA Mandate Tax

More than four years after passage of the Affordable Care Act, the Obama administration continues to drag its feet on implementation of paperwork requirements for the individual mandate tax, turning it into a "toothless legal relic," the American Action Forum said Tuesday.

The AAF, whose president is former Congressional Budget Office Director Douglas Holtz-Eakin, said Tuesday that the administration has apparently decided not to include the mandate as part of the 2015 tax season.

According to the AAF, the IRS submitted a proposal for collecting the AAF tax on Aug. 23, 2013, requesting that it be approved within three days. But the White House ignored the 72-hour request and ended up rejecting the proposal nearly a year later.

As of Tuesday, there does not appear to be "any information in the general tax collection" about the so-called "shared responsibility payment" – the Obama administration's term for the individual mandate tax – the AAF said.

"For all the rhetoric about the importance of the mandate," it added, "the White House keeps kicking the can down the road on implementation." The delays "have transformed the individual mandate from an assault on basic freedom to a toothless legal relic."

The Daily Caller had reported earlier that the administration had already slashed the percentage of the uninsured who would have to pay the tax. Citing information compiled by the CBO and Congress' Joint Committee on Taxation, the website reported that just 13 percent of the uninsured would be required to pay the levy, which in 2014 is either $95 or 1 percent of annual income. On Jan. 1, it jumps to 2 percent of income or $325.

Some of the "hardship exemptions" granted by the administration included home foreclosure, bankruptcy, homelessness, death of a close family member, receiving a cut-off notice from a utility company, being victimized by a fire, and suffering domestic abuse.
