Anchorage May Opt Out of Alaska's New Marijuana Law

Alaska's largest city is considering opting out of the state's new law that legalized recreational marijuana use, the Huffington Post reported.

Residents are invited to speak before the Anchorage Assembly on Tuesday on whether to ban commercial pot facilities within their city. The new state law goes into effect in February, the Post said.

The public comment period comes after Alaska residents in November approved Ballot Measure 2, which legalized marijuana use across the state, according to the Post. It allows cities to opt out, with Anchorage becoming the first to step up to consider just that.

The initiative's co-sponsor said he was concerned that such a move marked a step back, and he is urging residents to email and contact their assembly representatives, the Alaska Dispatch News reported.

"We hope to remind people (that) why we’re doing this kind of stuff is to take it out of the hands of criminals, and now the Assembly is stepping in to try to prevent this," co-sponsor Tim Hinterberger told the Dispatch.

Alaska voters approved Ballot 2 by a 52-48 percent vote. It allows marijuana possession for those 21 and older and also creates a structure for the legal sale of marijuana across the state, a commercial move that does not go into effect until 2016, the News Miner reported.

Moving forward, the law says the state must decide whether it will create a marijuana control board or put such regulating power into the hands of local governments.

A legislative analysis and comparisons to similar measures in Oregon, Washington State and Colorado was released in late November to help state lawmakers plan on marketing, labeling, health and safety, and distribution, among other issues that will come with implementing the new law.
