Court Green-Lights Tough Texas Abortion Restrictions

A federal appeals court Thursday allowed Texas to begin enforcing strict new abortion restrictions that will effectively close all but seven abortion facilities in the nation's second-largest state.

A panel of the U.S. Court of Appeals for the 5th Circuit in New Orleans stayed a lower judge's ruling while it considers the overall constitutionality of key portions of Texas's 2013 abortion law.

U.S. District Judge Lee Yeakel ruled in August part of the law requiring Texas clinics to spend millions of dollars on hospital-level upgrades was less about safety than making access to abortion difficult.

Yeakel's decision suspended the upgrades requirement. But Texas is appealing, and won its request of the appeals court to let the state enforce the law during that process.

More than a dozen clinics across Texas will have to close, leaving facilities open only in Houston, Austin, San Antonio, and the Dallas-Fort Worth areas.

"This decision is a vindication of the careful deliberation by the Texas Legislature to craft a law to protect the health and safety of Texas women," said Attorney General spokeswoman Lauren Bean, The Dallas Morning News reports.

Amy Hagstrom Miller, one of the plaintiffs in the case, said the decision will force a "healthcare crisis, brought on by its own legislators."

"Today the Fifth Circuit Court of Appeals ruled on the side of politics, not women's health," she said.

Supporters of the law have argued the new requirements will decrease the risk of complications for abortion patients.
